Terms of Service

By accessing or using the BookAutomate platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

These terms apply to all users of the platform, including business owners who create booking pages ("Merchants") and individuals who book appointments through those pages ("Clients").

To use BookAutomate as a Merchant, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your business. You agree to notify us immediately of any unauthorized use of your account.

BookAutomate provides an online scheduling and booking management platform that allows Merchants to create customizable booking pages, manage appointments, process payments, and communicate with clients.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes that affect your use of the platform.

You agree to use BookAutomate only for lawful purposes and in accordance with these terms. You may not use the platform to:

Engage in any activity that violates applicable local, state, national, or international laws or regulations.

Transmit any material that is defamatory, obscene, fraudulent, or that infringes on the intellectual property rights of others.

Attempt to gain unauthorized access to our systems, interfere with the proper functioning of the platform, or reverse-engineer any aspect of the service.

Use the platform to send unsolicited communications (spam) or collect personal information of other users without their consent.

Merchants on paid plans agree to pay all fees associated with their subscription tier as described on our Pricing page. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

If you enable payment collection from your clients, BookAutomate facilitates the transaction through third-party payment processors. You are responsible for any disputes, chargebacks, or refund requests from your clients.

We reserve the right to change our pricing with 30 days advance notice. Price changes will take effect at the start of your next billing cycle.

The BookAutomate platform, including its design, features, code, documentation, and branding, is the intellectual property of 321 Digital and is protected by copyright, trademark, and other applicable laws.

You retain ownership of all content you upload to the platform, including your business information, service descriptions, and custom branding. By uploading content, you grant us a limited license to display and distribute it as necessary to provide the service.

You may not copy, modify, distribute, or create derivative works based on our platform or any part thereof without our prior written consent.

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

As a Merchant, you are responsible for ensuring that your use of client data collected through BookAutomate complies with applicable privacy laws, including providing appropriate notices and obtaining necessary consents from your clients.

BookAutomate is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, 321 Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of or inability to use the platform.

Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless 321 Digital, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the platform, your violation of these terms, or your violation of any rights of a third party.

You may close your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately, and we will delete your data in accordance with our Privacy Policy.

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if your use of the platform poses a risk to other users or our systems. We will provide notice and an opportunity to cure where reasonable.

These terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved in the state or federal courts located in Denver, Colorado. You consent to the personal jurisdiction of these courts.

We may update these Terms of Service from time to time. We will notify you of material changes by email or through a notice on the platform at least 30 days before the updated terms take effect.

Your continued use of BookAutomate after the effective date of updated terms constitutes your acceptance of those changes.
